Equipment Use Waiver

VillageOS Equipment Use Waiver, Release, and Assumption of Risk

In consideration of being permitted to operate or handle tools, machinery, vehicles, or other equipment owned, leased, or supplied by VillageOS ("Equipment"), I, the undersigned Participant (and Parent/Guardian if under 18), acknowledge and agree to the terms below.

1. Training and Authorization. I will not operate any Equipment unless I have received training on it from an authorized Village Manager or qualified instructor and have been expressly authorized to use it. I will not allow unauthorized persons to use Equipment under my supervision.

2. Assumption of Risk. I acknowledge that operating Equipment involves serious inherent risks including, but not limited to: cuts, crush injuries, burns, amputations, eye injuries, hearing loss, electric shock, falls, fire, fuel and chemical exposure, vehicle rollover, and death.

3. Personal Protective Equipment (PPE). I agree to wear all required PPE — including but not limited to safety glasses, hearing protection, gloves, sturdy footwear, helmets, chaps, and high-visibility clothing — as appropriate for the Equipment in use.

4. Inspection and Reporting. I will inspect each piece of Equipment before use, will not operate any Equipment that appears damaged, unsafe, or malfunctioning, and will immediately report any damage, malfunction, near-miss, or incident to a Village Manager.

5. Release of Liability. I voluntarily release, waive, and covenant not to sue VillageOS, its operators, owners, managers, directors, officers, employees, contractors, volunteers, landowners, and representatives ("Released Parties") from any and all liability arising from any loss, damage, illness, or injury sustained while handling or operating Equipment, whether caused by negligence of the Released Parties or otherwise.

6. Damage to Equipment. I understand that VillageOS may, at its discretion, hold me responsible for damage to Equipment caused by my negligence, misuse, or unauthorized use.

7. Medical Treatment. I authorize VillageOS to seek and provide reasonable emergency medical care if needed and accept financial responsibility for any treatment received.

8. Severability and Governing Law. This waiver is governed by the laws of the Province of Ontario, Canada. If any provision is held invalid, the remaining provisions remain in full force.

9. Acknowledgement. I have read this waiver in full, understand its terms — including that I am giving up substantial rights — and acknowledge I am signing it freely and voluntarily.
